You agree to indemnify, defend and hold harmless Generator and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. It was not and never will be our fault – OK?


The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. Feel free to write and tell us.

Terms and Conditions

Generator is giving 2 new businesses the chance to win one year of free office space in either of their 3 buildings in Auckland and their new building at 30 Waring Taylor St in Wellington. These terms and conditions are available at (the "Website").

Promoter: Generator New Zealand Ltd, Level 1, 22 - 28 Customs Street East, Auckland, 1010, New Zealand

Entry Restrictions: Open only to New Zealand businesses that meet the following criteria:

  1. In operation for no longer than 36 months;

  2. 10 employees or less;

  3. New Zealand wide;

  4. Established business plan;

  5. Ready to accelerate; and

  6. The business is a legal business (pursuant to New Zealand law).

Any businesses associated with directors, management or employees (or the immediate families of directors, management or employees) of the Promoter, or of the participating agencies or companies associated with the Promotion, are specifically excluded from entry into the Promotion.

Satisfaction of the criteria above by an entrant business is at the sole discretion of the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

Promotion Period: Entries may be submitted through the Website from [8:00am] Monday July 12th 2021 until [5:00pm] Friday 6th August 2021.

How to Enter:

  1. Information regarding the Promotion and how to enter forms part of these Conditions. By entering, entrants accept these Conditions.
  2. To enter, entrants must go online to the Webpage and complete an entry fields. Multiple entries are not permitted.
  3. The Promoter is not responsible for any entries which are not completed due to technical difficulties with the entry mechanism and/or the Website. Incomplete or indecipherable entries will be deemed invalid.
  4. By entering the Promotion, each entrant warrants that all information submitted by them is true, complete, accurate and does not infringe any other party’s rights.
  5. The top ten entrants (the "Finalists") will be selected by the Promoter on Wednesday 11th August 2021. Each Finalist will be contacted by the Promoter using the details provided. If a Finalist is deemed by the Promoter in its sole discretion not to comply with these Conditions, their entry will be discarded and a replacement Finalist will be selected by the Promoter. All reasonable attempts will be made to contact each Finalist. If a Finalist cannot be contacted within 5 working days of the announcement, that Finalist will forfeit any right to participate in the live pitch. The Promoter’s selection of the Finalists is final and no correspondence will be entered into.
  6. The Finalists will be ‘judged’ by the judging panel who will select the top three. The top three will then be contacted by the promoter and may be asked to be interviewed on video as part of the winner selection process. The two winners will be announced before August 25th, 2021. The judges' selection of the winner of the Prize will be final and no correspondence will be entered into. The Promoter reserves the right to disqualify any entrant on reasonable grounds or to refuse to award the Prize to an entrant that the Promoter decides (in its sole discretion) has violated the Conditions or won using improper, unfair or fraudulent means.
  7. By entering the competition entrant businesses and the individuals associated with those businesses agree to the use of their details provided in the entry form in the Promoter's (and agencies or companies associated with the Promotion) advertising material and to co-operate in all advertising, marketing and publicity material and activities the Promoter may produce or arrange.


The prize is as set out below:

  1. Generator office space – up to 10 dedicated desks in the shared areas split across Auckland and Wellington for 12 months, with the Auckland location at the Promoter's choosing. The Wellington location will be at 30 Waring Taylor St. Included with the desks are utilities, power, ultrafast WIFI and internet, cleaning, concierge services, furniture for all employees and use of on floor meeting facilities, kitchen facilities and fully furnished shared space. The 12 months is to commence between November 1st 2021 and March 1st 2022 (but note that the Promoter is open to negotiation in respect of the start date so long as it is no later than 1 June 2022);
  2. Prize pack also includes:
    1. Digital Marketing Audit courtesy of up to the value of $2500
    2. Tailored Salesforce proposal, tailored for winning businesses – value TBC
    3. 10 x free tickets to TEDx Auckland’s next event – value $2000 – timing TBC
    4. 5 hours free use of Generator’s meeting & event suites – redeemed within winners 12 month lease term – value $1500

(together, the "Prize").

The winner of the Prize must enter into a Generator NZ Licence Agreement (as amended from time to time) in respect of the dedicated desks and comply with the relevant obligations therein (excluding any obligation to pay a Licence Fee, Deposit or Bond).

The Prize is not exchangeable or transferable. If the specified Prize (or any part of it) becomes unavailable due to circumstances beyond the control of the Promoter, the Promoter may substitute a Prize of like or equal value.

Additional terms for the Promotion

The winner takes the Prize entirely at their own risk and, to the maximum extent permitted by law, the Promoter will not be liable to the winner in respect of any claim for any loss, damage or injury whatsoever (including without limitation, any consequential, indirect, special, punitive or incidental damages) or for any physical or mental injury suffered by the winner as a result of or in connection with the Promotion, these Conditions or by reason of the utilisation of the Prize.

The entrant releases the Promoter, their directors, managers, staff and agents from and disclaims all claims, whether in contract or tort or otherwise in respect of or arising from the Conditions, Promotion or Prize to the maximum extent permitted by law. If a court of competent jurisdiction holds the Promoter, their directors, managers, staff or their agents or employees liable in respect of any matters arising under or incidental to this Promotion, then the total aggregate liability shall be limited to $2,000.

The Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Conditions, Promotion or Prize. The Promoter is not liable to any entrant or winner for any loss or damage as a result.

The Terms are governed by the laws of New Zealand and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts

Privacy Policy:

The Promoter collects personal information about the individuals associated with entrant businesses including names and contact numbers in order to run the Promotion and promote the Promoter's business. If an individual elects not to provide the information set out in these terms and conditions or the online entry form, that associated entrant's entry into the Promotion will be invalid. By providing the personal information to the Promoter, the individual authorises the Promoter to store such information on the Promoter’s database and use the information for future marketing purposes regarding its products, including contacting the individual electronically. Individuals have the right to: (a) ask for a copy of any personal information the Promoter holds about that individual; and (b) to ask for it to be corrected if the individual thinks it is wrong.
